FIRST DATA MERCHANT SERVICES MÉXICO, S. DE R.L. DE C.V. (hereinafter referred to as (“First Data”), whose offices are located at Jaime Balmes numero 11, Torre “D”, Piso 4, Colonia Los Morales, Delegacion Miguel Hidalgo, C.P. 11510, is the Responsible Company (the “Responsible”) for the lawful treatment, controlled and informed use, storage and disclosure of the personal data, which we collect in order to achieve the corporate targets through all the areas of the business and reiterate the commitment with the privacy and the right to the informational self-determination.

This Privacy Notice has the purpose of informing you about the treatment that will be given to your personal data when they are collected, used, stored and/or transferred by “First Data”, which is performed in accordance with the Federal Law for Protection of Personal Data in Possession of Individuals (hereinafter, the “Law”) and its Regulation.

Personal Data Collected By Us

You may navigate through our web site without providing us with any data; however, there are certain sections in the web site where you may voluntarily provide your data. Your data may be collected in different situations, whether contained in an e-mail, on an application for any of our products or services obtained personally, by telephone or through our web site, or those provided by you in connection with the establishment of a legal relationship; all the data will be used in Mexico and abroad by “First Data” and/or its controlling or controlled companies, affiliates, subsidiaries, parent companies or agents. These data may include any of the following: (i) Contact information, such as: Name, Address, Date of Birth, Federal Taxpayer Registry (RFC), Unique Population Registry Code (CURP), Fixed Telephone, Mobile and Fax Number, E-mail address; (ii) Identity Documentation, such as: Voter ID, Passport, Driving License, Military Service ID Card or Professional License; (iii) Academic Data, such as: Academic Record, professional diploma, Professional License number, specialty, academic certificates; (iv) Labor Data, such as: position in the company, address, fixed telephone, mobile and fax number, e-mail address, social security number, cv; (v) Family Information, such as: spouse and sons’/daughters’ names; (vi) Personal Reference, such as information of persons other than your relatives; (vii) Invoicing Data, such as: trade name of the company to be charged, fiscal address, RFC, name of the legal representative; (viii) Financial Data, such as: bank account numbers, payment method, financial institution and interbank CLABE.

Sensitive Personal Data

We hereby inform you that in connection with the purposes described in this Privacy Notice, whether as a candidate, employee, client or provider, First Data does not collect Sensitive Personal Data, considering it as any data which may affect the most intimate sphere of the human being.

Purposes and/or Use of the Personal Data

We may use your personal data with different purposes, depending on the particular circumstances in which they are collected, as well as for providing information and attention and your service. File of records of the contractual relationship for follow up of future services, financial management, preparation and delivery of quotations, formalization of contracts, sending of publications, invoices and collection, observing at all times our relationship with you and the specific Privacy Notice that, as the case may be, has been made available to you.

Minor Children and Disabled

First Data and its affiliates are a Company committed to the privacy of the minor children and the disabled; therefore, we do not intentionally collect or treat personal data of minor children or disabled persons when we do not have the express agreement of their parents, tutors or legal representatives. Use of Tracking Technologies

When you navigate in our web site, certain non-personal information is collected through "cookies," "server’s records” or "web beacons." The collection of this information is the result of the use and interaction with our web site and the collected information may consist on Internet Protocol addresses, your operating system, type of browser, information on your location (provided by mobile devices) and the route followed by you during the time you spend in our site.

These data are collected with the following purposes only: generating statistics concerning the visits to our web site, the time spent in our web site and the reference sites which may have brought you to our site. Transference of Personal Data

First Data may transfer your personal data to third parties, whether they are individuals or legal entities other than this Company, with whom First Data has a legal relationship, only to fulfill the purposes described in the Privacy Notice. First Data may also transfer your personal data in the cases specifically provided by the Law, in such regard your information may be shared with: (i) Insurance Companies; (ii) Companies operating with First Data some kind of software and any informatics infrastructure used as platform to keep its data bases updated and protected; (iii) courier services providers; (iv) payroll management services providers; (v) providers responsible for the destruction of the physical documentation delivered in order to fulfill the purposes of the rendered services; and (vi) Collection Agencies.

The authorization of the Holder, in accordance with this section, entitles the Responsible and/or its Managers to transmit the Personal Data of the Holder to such providers, in the understanding that the latter have the duty, based on the corresponding contracts, to keep the confidentiality of the Personal Data provided by the Responsible and/or its Managers and to observe this Privacy Notice.

First Data agrees not to transfer your personal information to others without your consent, except for the exception cases provided by the Federal Law for Protection of Personal Data in Possession of Individuals and its Regulation, as well as to make such transference in the terms provided by such Law and Regulation.

If you do not state your opposition to the transference of your personal data, it will be understood that you have given your consent.

Security Measures

First Data has adopted security, administrative, technical and physical measures which are necessary and within its control to protect the personal data against damage, loss, alteration, destruction or any unauthorized use, access or treatment.

Rights in Respect to Your Personal Data

As personal data holder, you may exercise before the Personal Data Responsible of First Data, the rights of access, rectification, cancellation and opposition (“ARCO” rights). Likewise, you may revoke, at all times, the consent that you have given and which is necessary for the treatment of your data, as well as to limit the use or disclosure thereof.

The foregoing may be exercised by sending your request, in the terms established by the Law, to the e-mail address or to the address shown on the first paragraph of this notice.

For ease of reference, the ARCO rights are briefly described below:

  • Access: to be informed about which of your personal data are contained in the data bases of First Data, with which purpose you use such personal data, the origin and communications made therewith and, in general, the conditions and general issues related to their treatment.
  • Rectification: your personal data may be corrected or updated when they are inaccurate or incomplete.
  • Cancellation: your personal data may be deleted, whether completely or partially, from the data bases of First Data when you consider that they are not being treated in accordance with the principles and duties established by the Law.
  • Opposition: when you have a legitimate cause, you may oppose to the use or treatment of your personal data.

DE C.V., hereinafter (“First Data”), is responsible for the treatment of your personal data, whose offices are located at Calle Jaime Balmes No. 11, Torre “D”, Piso 4, Colonia Los Morales, Delegacion Miguel Hidalgo, C.P. 11510, Mexico, Distrito Federal. As part of the process to register your visit to the facilities and as a security measure, it is likely that “First Data” requests and obtains your information from you, in order to acknowledge your identity and the purpose of your visit.

The information that will be requested to you may contain personal data, such as your full name, even in the recording of your name at any of our control points, and we may request that you provide us with a personal identification, only with the purpose of recording your visit to our offices or the information of the person visiting the offices, and therefore “First Data” will not transfer such data to others and will not use such data with any other purpose.
